3. Data Processing when using the websites and offered Services

Usage Data

Every time you access our websites, information is automatically sent to our website's server by the browser on your terminal device. This information is temporarily stored in a so-called log file. The following information may be collected:

• Name and URL of the retrieved file,

• Website from which access is made (referrer URL),

If you grant us access to your current location via the service, this occurs—depending on usage—via our apps for commercial drivers or owner-operators, which are covered by our separate privacy policy. If this occurs via our websites, you must have consented to geolocation in your browser or your device's settings.

We then collect precise or approximate position data of your device (e.g., GPS data) to offer you location-based functions of the service, particularly for route calculation and address queries. You can deactivate access to your location data at any time in your device settings. Please note, however, that without this access, automatic localization is no longer possible, and we cannot fulfill the user agreement in this regard. Your location data is used exclusively for this purpose and only as long as you maintain the use of this function.

Use of our "click2cargo" Service

With our "CLICK2CARGO" service, you have the opportunity to enter, manage, and process a variety of information, tasks, and activities. This includes in particular:

• Data on your business operations and existing permits,
• Information about drivers, contact persons, and other employees of your company and their contact details,
• Vehicle identification data and planned transport orders,
• Data on your business partners and other business contacts,
• Contract, payment, and insurance data.

Data processing by us can essentially be divided into two categories:

1. Provision of the Service: We provide the "CLICK2CARGO" service on our websites to fulfill the user agreement between you and us, or between your company (referred to as "user") and us, or to initiate such an agreement and provide information for you. If third-party companies and external service providers are involved in the fulfillment and processing of our services, your data will be passed on to them to the extent required. In addition to contract processing, we use the data collected from you during the execution of the contract to occasionally inform you about new offers and promotions.
2. Optimization and Advertising: When the websites are called up, various information is exchanged between your device and our server. This may also include personal data. The information collected in this way is also used, among other things, to optimize our websites or to display advertising in your device's browser. Insofar as we also provide you with a mobile application ("App") with access to selected functions of the service within the framework of the user agreement, a separate privacy policy applies to its use. This can be accessed within the App.

Creation of a User Account (Registration) and Login

You can register on our websites to use our service. When you create a user account for this purpose or log in with it, we use your access data (email address, username, and password) to grant you access to and manage your user account. The access data and other mandatory information during registration (together "mandatory information") are marked with an asterisk and are required for the conclusion of the user agreement. If you do not provide this data, you cannot create a user account and a contract conclusion is not possible.

As part of the registration process, you will be asked to submit the following documents to verify your identity and the nature and object of your business: current commercial/trade register excerpt, valid road haulage permit (if applicable as a community permit – "EU License"). Upon receipt of these documents, we link the personal information contained therein with your user account. Providing these documents is voluntary. You reserve the right to prove to us the requirements for concluding a contract in accordance with the terms of use in another suitable way.

Furthermore, you can provide the following voluntary information during registration: web address, VAT ID, fax number.

If you wish to use the functions of the service as a general user in the company of your employer/principal or wish to manage the user account on their behalf, the account administrator can create a separate user profile with access authorization for you by providing access data (email address, username, and password). We then use this information in accordance with the description for mandatory information. If you do not provide this data, you will not be able to use the service, and we will not be able to fulfill the user agreement in this respect.

We use the mandatory information to authenticate you upon login and to follow up on requests to reset your password. The data entered and documents submitted by you during registration or login are processed and used by us to verify your authorization to manage the user account, to check the requirements for concluding a contract, to enforce the terms of use of the service and all associated rights and obligations, and to contact you to send technical or legal notices, updates, security alerts, or other messages concerning, for example, the management of the user account.

We use voluntary information to display it in accordance with your settings within the service and, at your request, to make it accessible to other users in the password-protected area of the service.

This data processing is justified by the fact that the processing is necessary for the fulfillment of the user agreement pursuant to Art. 6 (1) (b) GDPR for the use of the service, or we have a legitimate interest in ensuring the functionality and error-free operation of our websites and the service, which outweighs your rights and interests in the protection of your personal data within the meaning of Art. 6 (1) (f) GDPR.

3.1 Specific Provisions for the "c2c Driver App"

In addition to the general provisions of this policy, the following regulations regarding location processing apply to users of the c2c Driver App (in particular commercial drivers and entrepreneurs).

📍 Location Information

To fulfill the core promise of click2cargo—matching freight along real routes to avoid empty runs—the processing of location data is technically mandatory.

3.1.1 Type of Location Data Collected Our App collects the following information:

• Precise Location: GPS and network-based location data.
• Approximate Location: Data for coarse localization.
• Background Location Data: Data collected even when the App is closed or not actively being used in the foreground.

3.1.2 Purpose of Processing We use this data in accordance with Art. 6 (1) (b) GDPR (Performance of Contract) to:

• Enable real-time tracking of deliveries.
• Assign suitable freight inquiries near the current location or along the route.
• Offer route navigation and optimize travel paths.
• Ensure automated status updates on delivery progress.
• Increase the efficiency of the service and enhance transport safety.
• Prevent fraud and ensure account security.

3.1.3 Use of Background Location The App records location data in the background to:

• Continuously track the progress of an active delivery without the driver having to keep the App permanently in the foreground.
• Provide customers (carriers/shippers) with real-time updates on the Estimated Time of Arrival (ETA).
• Maintain seamless proof of delivery.
• Note: Background tracking is active as long as a trip/delivery is active or the user is logged in and ready to accept orders.

3.1.4 Disclosure of Location Data We share location data exclusively within the scope of the intended purpose with:

• Shippers/Customers who receive or have commissioned the respective delivery (supply chain transparency).
• Our backend servers to provide system functions.
• IT service providers who technically support App operations (data processing). Your location data will not be sold to third parties.

3.1.5 User Control and Revocation You have full control:

• You can deactivate location sharing at any time in the settings of your operating system (Android/iOS).
• Background tracking can be stopped by ending the trip or logging out.
• Important: Without location sharing, we cannot technically fulfill the user agreement (automatic matching/tracking).

4. Transfer and Disclosure of Data

In principle, your personal data will not be passed on to third parties by us unless this is necessary for the fulfillment of our contractual obligations or you have expressly consented to the transfer. A transfer of your data to third parties takes place in the following cases:

• Service Providers and Processors: We sometimes use external service providers (e.g., IT service providers, data centers, payment service providers) to fulfill our obligations to you. These service providers only receive the necessary data and are contractually obligated to comply with data protection regulations.
• Legal Obligations: Your data will also be passed on if we are legally obliged to do so or if this is necessary to enforce our rights, in particular to assert claims arising from the contractual relationship ( 6 (1) (c) and (f) GDPR).

5. Changes of Purpose

• Google Maps: Our website uses Google Maps to display interactive maps directly and to make it easier for you to use the map function.
